Terms of Use

1. Purpose
These Terms of Use govern access to and use of Nimblo Studio, a platform that enables users to host, organise and share photographs and other images.
By accessing or using Nimblo Studio, you agree to be bound by these Terms of Use.
2. Access to the Service
Access to Nimblo Studio is available to individuals who have the legal capacity to enter into binding agreements or who have obtained the consent of their legal guardian where required.
Nimblo Studio reserves the right to modify, suspend or discontinue all or part of the Service at any time, whether temporarily or permanently, for technical, maintenance or security reasons.
3. User Responsibilities
Users are solely responsible for the content they upload, store, share or publish through Nimblo Studio.
By using the Service, users warrant that:
- they own the images they upload or have obtained all necessary rights, licences and permissions to host and use them
- the images do not infringe the intellectual property rights, privacy rights, image rights or any other rights of third parties
- the content complies with all applicable laws and regulations
Users remain solely responsible for any consequences arising from the publication or sharing of their content.
4. Ownership of Content
Users retain full ownership of all intellectual property rights in the images they upload to Nimblo Studio.
No ownership of user content is transferred to Nimblo Studio.
Users grant Nimblo Studio a limited, non-exclusive licence solely for the purpose of operating the Service, including storing, backing up, processing, displaying and making available their images in accordance with the privacy settings they have selected.
5. Public Portfolio Content
Where a user chooses to make images publicly available through their portfolio, they grant Nimblo Studio a non-exclusive, royalty-free licence to reproduce and display those images for promotional and marketing purposes.
Such use may include, but is not limited to:
- the Nimblo Studio website
- social media channels
- presentations and demonstrations
- promotional materials showcasing the Service and its features
This licence applies only to images that the user has intentionally made publicly accessible.
Users may withdraw this permission at any time by removing the relevant images from their public portfolio. Nimblo Studio will cease any future use of those images within a reasonable period, without affecting materials that have already been published.
6. Fair Use of Resources
To ensure the Service remains reliable and available to all users, users agree not to misuse the platform’s resources.
Examples of abusive use include, but are not limited to:
- repeatedly uploading and deleting files in order to circumvent storage limits or other restrictions
- using automated scripts or bots that generate excessive server load
- making an unusually high number of downloads, synchronisations or API requests
- creating multiple accounts to bypass quotas or service limitations
- using Nimblo Studio as a general-purpose backup service unrelated to image hosting and sharing
- attempting to impair the performance, stability or security of the Service
Where abusive use is detected, Nimblo Studio may take appropriate action, including limiting certain features, temporarily suspending access or permanently terminating the user’s account.
7. Prohibited Content
Users must not use Nimblo Studio to host or distribute:
- unlawful content
- content that infringes the intellectual property rights of others
- defamatory, hateful, abusive, violent or discriminatory content
- malware or any content intended to compromise the security or integrity of the Service
- any content prohibited under applicable law
Nimblo Studio reserves the right to remove any content that is unlawful or breaches these Terms of Use.
8. Service Availability
Nimblo Studio will use reasonable efforts to ensure that the Service remains available.
However, uninterrupted availability cannot be guaranteed.
Users are strongly encouraged to keep their own backup copies of their images. Nimblo Studio shall not be liable for any loss of data resulting from technical failures, user error or events beyond its reasonable control.
9. Suspension and Termination
If a user breaches these Terms of Use, Nimblo Studio may, at its sole discretion:
- issue a warning
- temporarily suspend the user’s account
- restrict access to certain features
- permanently terminate the user’s account
Any action taken will be proportionate to the seriousness of the breach.
10. Changes to these Terms
Nimblo Studio may amend these Terms of Use from time to time in order to reflect changes to the Service, applicable legislation or technical requirements.
The latest version published on the Nimblo Studio website shall apply.
11. Governing Law
These Terms of Use shall be governed by the laws applicable in the jurisdiction where Nimblo Studio’s operator is established.
The parties agree to seek an amicable resolution of any dispute before commencing legal proceedings where reasonably possible.
